Download and read online Space Law Views of the Future in PDF and EPUB The utilization of outer space is fraught with dangers. In an effort to guarantee, as much as possible, the rights of victims of injury or damage caused by outer space objects, the United Nations, through its committee on the Peaceful Uses of Outer Space, adopted the 1972 Convention on International Liability for Damage Caused by Space Objects. The present volume is the first indepth analysis of the Liability Convention. In Part One, the author provides an article-by-article commentary on the Convention. In Part Two, the implementation of the Convention is reviewed in the light of the events surrounding the 1978 Cosmos 954 incident when a nuclear powered Soviet satellite disintegrated over northern Canada spreading radioactive debris over a vast area. In Part Three, the author investigates the role played by the Convention in the development of international tort law within the context of the work of the International Law Commission on the question of 'International Liability for Injurious Consequences Arising Out of Acts Not Prohibited by International Law'. Finally, in Part Four, the contribution of the Convention to general International Law is examined.
Download and read online Outlook on Space Law Over the Next 30 Years in PDF and EPUB This book is neither a historical treatise on the genesis and development of space law, nor a survey of the corpus, nor even a work of legal makebelieve, but simply an essay pursuing a line of enquiry opened up by the members of the European Centre for Space Law. It sets out to chart future trends in the light of the emergence of space law as a branch of international law and of the development of space activities themselves (new activities, new players, interpenetration of space law and national laws), a branch in which the rules and forms of international cooperation acquire a new dimension, transcending the concept of 'global' law. It is essentially prompted by a deep aspiration to see a rebirth - a revival - of that law.

Download and read online The Environmental Element in Space Law in PDF and EPUB While decades of space ventures have led to significant technological advances, space activities have also brought increasing environmental problems. This book examines the current international legal regimes in space law and environmental law in order to ascertain their applicability and efficacy in addressing environmental threats in the space sector. The research suggests mechanisms which could improve environmental protection in the sector and strengthen the environmental element in space law. These mechanisms include a variety of norm-setting strategies used in international environmental management. Special attention is drawn to the potential of environmental impact assessment in the space sector and to dispute resolution procedures. Like other areas of human activities, the space sector should accommodate both economic interests and environmental protection in line with the principle of sustainable development

Download and read online Common Security in Outer Space and International Law in PDF and EPUB This publication explores the concept of common security and the legal foundations for its application in outer space law, based on the premise that outer space is an internationalised common area beyond the national jurisdiction of individual states, and therefore security in space must be the common security of all states. Chapters cover a range of issues including: the principle of the peaceful use of outer space, passive military uses, and multilateral negotiations to prevent an arms race in outer space; structural change of international law and the common heritage of mankind principle; and proposals for a multilateral agreement and the creation of an International Organisation for Common Security in Outer Space.

Download and read online Exclusive Use in an Inclusive Environment in PDF and EPUB This book aims to find a workable interpretation of the non-appropriation principle that is compatible with both the existing international space law framework and the move of the private space industry towards the mining of asteroids and other celestial bodies. It does so by analysing the rules on the use of orbits as limited natural resources as a concrete indication of how space resources can be exploited by one user while respecting the non-appropriation principle and the interests of other users in space. This analysis is complemented by a thorough review of the meaning of property rights in the context of the existing international space law regime. This allows the author to distinguish between the lawful exploitation and unlawful appropriation of resources in a manner that could pave the way for a workable asteroid mining regime that takes into account the needs of individual companies and the international community. Exclusive use in an inclusive environment frames the legal regime of the exploitation of natural resources in outer space as the most pressing example to date of the tension that arises between the rights of a single spacefaring actor and the interests of the broader international community. Though academic in its approach in dealing with one of the most fundamental issues of space law to date, the book has very practical ambitions. By offering a pragmatic interpretation of the space law principles that are likely to remain the legal foundations of asteroid mining for the foreseeable future, Exclusive use in an inclusive environment hopes to inform academics, practitioners and policymakers alike in their future attempts at working out a fair, equitable and effective management regime for the exploitation of natural resources in outer space.
Download and read online The Concept of the Common Heritage of Mankind in International Law in PDF and EPUB The concept of the common heritage of mankind is one of the most extraordinary developments in recent intellectual history and one of the most revolutionary and radical legal concepts to have emerged in recent decades. The year 1997 marks the thirtieth anniversary of the advent of the concept in the domain of public international law. Ever since its emergence, it has become evident that no other concept, notion, principle or doctrine has brought as much intensive debate, controversy, confrontation and speculation as the common heritage phenomenon did. This is because it is a philosophical idea that questions the regimes of globally important resources regardless of their situation, and requires major changes in the world to apply its provisions. In other words, the application and enforcement of the common heritage of mankind require a critical reexamination of many well-established principles and doctrines of classical international law, such as acquisition of territory, consent-based sources of international law, sovereignty, equality, resource allocation and international personality. This book aims to explore the legal theory and implications of the concept of the common heritage of mankind. It addresses almost all aspects of the concept in the light of the experience of three decades. The author takes into account the elements of the common heritage concept in the fields of jurisprudence, outer space law, the law of the sea, the law of Antarctica, international environmental law, human rights and general principles of public international law. It tries to develop a normative framework through which the concept may offer alternatives for the governance of the global commons.
Download and read online Law Making in the International Community in PDF and EPUB As the world approaches the end of the twentieth century it becomes clear that the global legal system governing relations between the members of the international community is passing through a period of profound change. The traditional lawmaking techniques, established largely at the beginning of this century, were constituted so as to provide for only gradual reforms within a limited and homogeneous community of states. Faced with a growing number of global problems, the international community has discovered that the traditional legal system lacks effective procedures for rapid generation of new international legal norms. "Law-Making in the International Community" examines to what extent the transformations in the social and the legal infrastructures of the international community have affected the traditional rules, determining how international law is to be made or changed. By focusing on actual state practice, official statements of governments and the pronouncements of the World Court, this book seeks to clarify the content and significance of the existing community consensus concerning the authoritative methods of lawmaking.
