Chapter 1 discusses sources of the law and how fairness and due process, federal and state statutes, and various guidelines shape the law. Tort law, corporal punishment, search and seizure, defamation of character, and negligence are covered in chapter 2. Chapter 3 details issues surrounding student privacy and such issues as confidentiality of records, whereas chapter 4 describes the staff-student relationship and how the law governs confidentiality, sexual misconduct, physical contact, and other behaviors. Since student confessions can be an important part of the teacher-student relationship, legal aspects of confidentiality, legal immunity, case law, the student journal, and school retreats are discussed. Chapter 6 looks at child abuse and neglect and considers statutory guidelines, inservice education, who should file a child-abuse report, and teachers and abuse. Sexual harassment is treated in the next chapter, which includes an overview of actions that constitute harassment and suggested policies for addressing reports of harassment. Other topics receiving treatment include accommodating students with special needs, extracurricular and cocurricular activities, personal conduct of professional staff, gangs, copyright law, school handbooks, and Catholic-school finances. Specifically, the study investigated the legal issues impacting on Catholic schools, principals' understandings of these legal issues and the sources used in gaining these understandings. The congruency between these understandings and the current interpretations of areas of the law were also examined, along with the influence legal issues have on principals; in particular, their perceptions of how these legal issues relate to carrying out their leadership roles aligned with the characteristics and ethos of the Catholic school. In this overall context, the influence of a number of variables such as school complexity, location, and primary and secondary school environments was also examined. The study commenced with an examination of the development of Catholic schools within the Australian social/cultural context, an exploration of leadership as it relates to Catholic schools and a survey of the literature indicating the scope and nature of the legal matters impacting on schools within the Australian legal framework. To gather data relevant to the purposes of the study, a Survey Questionnaire was constructed and distributed to principals of all systemic Catholic schools administered by the Brisbane Catholic Education Centre. The quantitative and qualitative data provided via this instrument was supplemented and corroborated by information gathered through discussions, observations, and reference to documentation and records. Huff, a court case that challenged the employment of nearly 150 Catholic sisters in public schools across New Mexico in 1948. Known nationally as the "Dixon case," after one of the towns involved, it was the most famous in a series of midcentury lawsuits, all targeting what opponents provocatively dubbed "captive schools." Spearheaded by Protestants and Other Americans United for Separation of Church and State, the publicity campaign built around Zellers drew on centuries-old rhetoric of Catholic captivity to remind Americans about the threat of Catholic power in the post-War era, and the danger Catholic sisters dressed in full habits posed to American education. Americans at midcentury were reckoning with the U.S. Supreme Court's new mandate for a "wall of separation" between church and state. At no time since the nation's founding was the Establishment Clause studied so carefully by the nation's judiciary and its people. While Zellers never reached the Supreme Court, its details were familiar to hundreds of thousands of citizens who read about them in magazines and heard them discussed in church on Sunday mornings. For many Americans, Catholic and not, the scenario of sisters in veils teaching children embodied the high stakes of the era's church-state conflicts, and became an occasion to assess the implications of separation in their lives.
